MinusDo I need to secure a Zoning Permit to construct a Fence or Accessory Building on residential property?
YES--A Zoning Permit is required prior to the construction, erection, alteration of any building costing or valued at $50.00 or more; which would include a Fence or Shed.
MinusDo I need to secure a Zoning Permit to install/construct a swimming pool on residential property?
YES--A Zoning Permit is required for all in-ground private swimming pools, and above-ground swimming pools with a pool liner excavation greater than two feet in depth. A Zoning Permit is not required for above-ground swimming pools with a pool liner excavation of two feet of less.
Minus/After securing a Zoning Permit, is it necessary to obtain a Building Permit from the Mahoning County Building Inspection Department?
YES--A County Building Permit is required as Step Two of all construction projects; with two (2) exceptions: A County Building Permit is not needed for the installation of a fence, and for accessory buildings (shed, decks, garages) less than 200 square feet in dimension.
MinusIs a Zoning Permit required for the application of exterior siding, roof reshingling, replacement of windows and doors on an existing dwelling?
NO--A Zoning Permit is not required for siding, reshingling, windows, and doors; however, if there is a change in the roof pitch requiring reconstruction of the roof before shingling, a permit is required.
MinusIs storm water runoff from one residential property to another an enforceable zoning issue?
NO--the diversion or redirection of storm surface water from one property to another is not a zoning issue, and represents a "civil matter" between the two property owners.
MinusCan unused, unlicensed, wrecked, or dismantled vehicles be parked or stored on residential property?
NO--No abandoned (an unlicensed vehicle is defined as being abandoned), wrecked, unused, or dismantled automobile, truck, jeep, van, recreational vehicle (motor home), trailer is permitted to be stored in an exposed manner in any yard area on residential property. Note that a vehicle not stored within a garage, in plain view or covered with any material, in a yard area is defined as being exposed storage.
MinusCan a property owner raise/shelter horses or other non-domesticated animals on residential property?
YES--A property owner can raise/shelter animals, exclusive of domesticated household pets, if the animals are sheltered one hundred (100) feet away from an adjacent residential house.
MinusHow long of a period of time is a Zoning Permit valid once issued for a construction project?
A Zoning Permit is valid for one (1) calendar year from the date of issuance, and within this calendar year all exterior walls, roof and doors must be completed on buildings.
MinusHow do I verify the zoning district classification or ownership for a parcel of property?
Either contact the zoning office at 330-799-3241; or check on line at: www.mahoningcountyoh.gov; click "Mahoning County"; click "Departments/Agencies; click "Auditor", click "Property Search"-enter by mailing address, name, or permanent parcel number.
MinusIs the parking of a vehicle on the street/public right-of-way an enforceable zoning issue?
NO--The Zoning Ordinance only regulates the use of the real property, i.e., the area inside the property pins. Any question/issue concerning vehicles parked on the street should be referred to the Austintown Police Department, 330-799-9721
MinusCan commercial vehicles be parked/stored on residential property?
Only one (1) commercial vehicle with a gross vehicle weight (gvw) less than 11,000 pounds is allowed to be parked/stored on residential property. Commercial tractor cabs and trailers are not permitted, in that they exceed 11,000 pounds gvw.
